We trade as Airborne Studio and as Airbuild. Both are trading names of Airborne Studio Limited. They are not separate companies.

2. About these terms

These terms tell you the rules for using the site. By using the site you confirm that you accept these terms and agree to comply with them. If you do not agree, you must not use the site.

The following additional documents also apply to your use of the site:

3. We may change these terms and the site

We may amend these terms at any time. Every version is dated and the current version is always the one published on this page. Check this page from time to time.

We may update and change the site from time to time, and we may suspend, withdraw or restrict all or part of it for business or operational reasons. We will try to give you reasonable notice of any planned suspension.

4. Accessing the site

The site is made available free of charge. We do not guarantee that the site, or any content on it, will always be available or uninterrupted.

You are responsible for making all arrangements necessary for you to access the site, and for ensuring that everyone accessing the site through your internet connection is aware of these terms and complies with them.

The site is directed to people and businesses in the United Kingdom. We do not represent that content on the site is appropriate or available in other locations.

5. The site is not for under-18s

The site is intended for business users. It is not directed at children and we do not knowingly collect personal data from anyone under 18.

6. Our intellectual property rights

We are the owner or the licensee of all intellectual property rights in the site and in the material published on it, including all written content, essays, articles, frameworks, methodologies, diagrams, illustrations, photography, code, typography and design. Those works are protected by copyright and other laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page from the site for your personal use, and you may draw the attention of others within your organisation to content posted on the site.

You must not modify the copies you have made in any way, and you must not use any illustrations, photographs, video, audio or graphics separately from any accompanying text.

Our status as the authors of content on the site must always be acknowledged.

You must not use any part of the content on the site for commercial purposes without obtaining a licence from us.

7. Text and data mining, and automated access

We expressly reserve all rights in the content of this site for the purposes of text and data mining, machine learning and artificial intelligence training and development.

No text or data mining or web scraping of this site is permitted without our express prior written consent. This includes any use of the site's content to train, fine-tune, evaluate, ground or otherwise develop any machine learning or artificial intelligence system or model.

This reservation applies notwithstanding any text and data mining exception, including the exception at section 29A of the Copyright, Designs and Patents Act 1988, and constitutes an express reservation of rights for the purposes of Article 4(3) of Directive (EU) 2019/790.

8. Do not rely on information on this site

The content on the site is provided for general information only. It is not advice on which you should rely.

We publish essays, frameworks and commentary about brand, design and technology. That material reflects our views at the time of publication. It is not professional advice and does not take account of your circumstances. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of content on the site.

Although we make reasonable efforts to keep the content on the site up to date, we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or current.

9. Interactive tools, including the Rebrand Readiness Audit

We may make interactive tools available on the site. These include the Rebrand Readiness Audit, which produces an indicative assessment based on information you provide.

The following applies to any such tool.

Output is indicative only. Any assessment, score, verdict or narrative produced by a tool on this site is generated automatically, in part using third-party artificial intelligence services. It is an indication, not a recommendation, and not professional advice. It is not a substitute for a proper assessment of your business.

Do not rely on it. You must not make any commercial, financial or strategic decision solely on the basis of output from a tool on this site. We accept no liability for any decision taken, or not taken, in reliance on that output.

Output may be wrong. Automatically generated output can be inaccurate, incomplete or misleading. It may vary between sessions for identical inputs.

Do not submit sensitive information. You must not submit confidential information, commercially sensitive information, personal data about other people, or any special category personal data into any tool on this site. Only submit information you are content to disclose.

Third-party processing. Information you submit is transmitted to and processed by a third-party artificial intelligence provider outside the United Kingdom in order to generate the output. Our Privacy Policy explains this, including the safeguards that apply.

No confidentiality or engagement. Using a tool on this site does not create any professional relationship between us, does not create any obligation of confidence, and does not commit either of us to any engagement.

10. Our responsibility for loss or damage suffered by you

Nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by English law.

If you are a business user:

We exclude all implied conditions, warranties, representations or other terms that may apply to the site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, the site, or use of or reliance on any content displayed on the site.

In particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

If you are a consumer:

Please note that we only provide the site for domestic and private use. You agree not to use the site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

If defective digital content that we have supplied damages a device or digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

11. Uploading content and using our tools

Any material you upload to the site, or submit into any tool on the site, is considered non-confidential and non-proprietary. You retain all ownership rights in it, but you grant us a limited licence to use, store and process that material for the purpose of operating the site and providing the tool to you.

Our Acceptable Use Policy sets out the standards that apply to any material you submit. You are responsible for ensuring that any material you submit complies with it.

We have the right to remove any material you post if, in our opinion, it does not comply with our Acceptable Use Policy.

12. We are not responsible for viruses

We do not guarantee that the site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the site, and you should use your own virus protection software.

You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which the site is stored, or any server, computer or database connected to the site. You must not attack the site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this provision you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the site will cease immediately.

13. Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to the site in any website that is not owned by you.

The site must not be framed on any other site, nor may you create a link to any part of the site other than the home page.

We reserve the right to withdraw linking permission without notice.

Where the site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or the information you may obtain from them. We have no control over the contents of those sites or resources.

15. Which country's laws apply

These terms, their subject matter and their formation, are governed by English law.

If you are a business user: you and we both agree that the courts of England and Wales will have exclusive jurisdiction.

If you are a consumer: you and we both agree that the courts of England and Wales will have jurisdiction, except that if you are a resident of Scotland or Northern Ireland you may also bring proceedings in your home jurisdiction.

16. Other important terms

If any provision of these terms is found to be unlawful, invalid or unenforceable, that provision shall be severed and the remainder of these terms shall continue in full force and effect. Where a provision could be enforced if part of it were deleted, that part shall be treated as deleted and the rest of the provision shall continue to apply.

If we delay in enforcing any of these terms, or fail to enforce them, that will not prevent us from enforcing them later.

A person who is not a party to these terms has no right to enforce any of them under the Contracts (Rights of Third Parties) Act 1999.
